1. Acceptance of terms
By accessing or using Swind (operated by Woodez, "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the service.
2. Description of service
Swind provides email marketing tools including Swaps (post-send image and link editing), Timers (live countdown timers for email), and Compressor (image optimization). All tools are provided as a subscription SaaS product.
3. Accounts
You must create an account to use Swind. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access.
4. Billing and payments
Paid plans are billed monthly or annually as selected at checkout. All fees are in USD and non-refundable except as required by law. We use Stripe to process payments, your payment information is never stored on our servers.
5. Trial period
New accounts receive a 14-day free trial with full access to all features. A valid credit card is required at signup. At the end of the trial period, your subscription begins automatically unless cancelled beforehand.
6. Acceptable use
You agree not to use Swind to send spam, distribute malware, violate any applicable law, or infringe on any third party's intellectual property rights. We reserve the right to suspend or terminate accounts that violate these terms.
7. Intellectual property
Swind and all related content, features, and functionality are owned by Woodez and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of content you upload to the platform.
8. Data and privacy
We collect and use data as described in our Privacy Policy. By using Swind, you consent to our data practices. We do not sell your personal data to third parties.
9. Limitation of liability
To the maximum extent permitted by law, Woodez shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of Swind. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Termination
Either party may terminate the agreement at any time. We may suspend or terminate your account for violation of these terms. Upon termination, your right to use the service ends immediately.
11. Changes to terms
We may update these terms from time to time. We will notify you of material changes by email or via the platform. Continued use of Swind after changes constitute acceptance of the new terms.
